Michigan Representative Brian Calley: It is now legal to babysit in Michigan… again.

Babysitting was illegal for a short while in Michigan, but thanks to Michigan Representative Brian Calley we can declare that it is now legal to babysit your neighbors children again. The issue apparently became known, nationally in fact, when the State of Michigan Department of Human Services sent a warning letter to Lisa Snyder, a resident near Grand Rapids, MI. She was apparently watching three children for about an hour each day before they caught their bus, and the letter alleged  she would be violating a law normally used to stop unlicensed “day-care centers.”

Representative Brian Calley (R-87) joined us live on Get Your Justice Live to discuss Department of Human Services regulations regarding babysitting, unlicensed daycare operations, and other programs that are weighing down the state’s budget and hindering the operations of the largest Michigan bureaucracy.

Monika Logan: Social Worker Discusses Parental Alienation on Get Your Justice Live

Monika-LoganMonika Logan, a social worker that has dedicated a portion of her studies and life to parental alienation studies joins Get Your Justice Live for a special episode of Get Your Justice Live.

Monika is providing support for professionals and parents that are dealing with parental alienation, a social dynamic that generally occurs due to divorce or separation. When a child expresses unjustified hatred or unreasonably strong dislike of one parent, making access by the rejected parent difficult or impossible. These feelings may be influenced by negative comments by the other parent and by the characteristics, such as lack of empathy and warmth, of the rejected parent.

It is important to note that the term should not be applied in cases of actual child abuse, when the child rejects the abusing parent to protect themselves.

From Parental Alienation Support: Regarding the terms PAS/PAD.

Parental Alienation Syndrome (PAS), or known by some as Parental Alienation Disorder, ” is a disorder that arises primarily in the context of child-custody disputes. Its primary manifestation is the child’s campaign of denigration against a parent, a campaign that has no justification. It results from the combination of a programming (brainwashing) parent’s indoctrinations and the child’s own contributions to the vilification of the target parent.”(Gardner, 1998).

How to Recognize PAS? Eight Manifestations:

1. A campaign of denigration
2. Weak, absurd, or frivolous rationalizations for the deprecation
3. Lack of ambivalence
4. The independent thinker phenomenon
5. Reflexive support of the alienating parent in the parental conflict
6. Absence of guilt over cruelty to and /or exploitation of the alienated parent
7. The presence of borrowed scenarios
8. Spread of animosity to friends and /or extended family of the alienated parent

[Editor Note: It is important to note that at the time of this publication, Parental Alienation Syndrome or Parental Alienation Disorder are not included in the current edition of the DSM (DSM IV-TR) and there is a current push to include the manifestation of disorder/syndrome in the next edition. The next edition is expected to be published in the year 2012.]

The average cost of a mediated divorce is less than $7,000 and of a collaborative divorce less than $20,000. This compares with nearly $27,000 for a divorce negotiated by rival lawyers and about $78,000 for a fully litigated divorce.

The adversarial process seems to be the most prevalent method of divorce, despite many peaceful or “less-adversarial” processes that are available, but not widely understood. For good reason, lawyers certainly make more money on the adversarial process and that seems to be what divorce is all about nowadays, who has the best lawyer.

The Michigan Fair Tax Association: Michiganders for the FAIRTAX website is located at http://www.mifairtax.org. The FAIRTAX establishes one rate for everyone; no more tax filings to the government. The FAIRTAX is considered a progressive tax, protecting the poor through a tax rebate on the necessities of life; no loopholes, therefore everyone pays the same rate on every purchase. Taxes will be shown on every sales receipt rather than hidden in the prices that are paid by the consumer.

With the FAIRTAX the tax rebate is often times called a “prebate” because it is paid to those that qualify on the necessities that you purchase every month even before you purchase them. Additionally, the prebate is only available to legal residents, so illegal immigrants will not qualify to receive reimbursements from the government on their purchases

The Michigan FAIRTAX will replace the Michigan Business Tax (MBT) and business to business transaction will no longer be taxed. Consumers throughout the state will likely see an immediate reduction in the cost of their retail goods on this point alone by about one fifth (20%) or higher. Quoting from How the MI FAIRTAX AFFECTS MICHIGAN EMPLOYERS: “Anything that goes into manufacturing or is necessary to performing a service is considered a business to business transaction. Thus, the attorney or accountant performing corporate work wouldn’t be taxed, but creating a will or doing an individual tax return would be. Only the final sale of a product or the final purchase of the service would be taxed. The Michigan FairTax would stop the double, triple, and cascading taxation which goes on all the time Michigan.Orig.

Q: With Michigan’s bad economy is now the time to make a drastic change to the state tax code?
A: Michigan’s current woes are precisely the reasons why Michigan should lead the nation by adopting the MI FairTax. Many other states  including Florida, Texas, North Carolina, Tennessee, Wyoming, and Nevada all use sales tax as their primary source of revenue to pay for state services. All of their economies are doing substantially better than Michigan. In fact, some of those states are the most competitive and economically strongest in the nation.

Q: Won’t people think that the Michigan FairTax unfairly shifts the burden of taxation from businesses to the individual taxpayers of the state?
A: Businesses don’t pay taxes, people do. Businesses pass the taxes along to the consumers who purchase their goods and services. The higher business taxes are in Michigan the more difficult it is for businesses trying to operate in this state and be competitive. Michigan needs employers.

Q: Is it realistic to expect Michigan residents to support the Michigan FairTax when it seems to place a new tax on food and other necessities?
A: Consumers are already paying the taxes for all businesses in inflated prices. Even Food and Medical businesses currently pay income and business taxes which are embedded in today’s prices. The MI FairTax eliminates these hidden taxes.

Q: What exactly is the “pre-bate”?
A: To protect the poor, and to assure that no tax will be paid on necessities, the MI FairTax provides for a monthly electronic payment to every legal household in the amount of what the tax would be for purchases up to the poverty level based upon household size. This untaxes the poor and causes the MI FairTax to be progressive. Because of the prebate, a family of 4 spending $21,200/yr would have a 0% effective tax rate, and if the family spent $50,000 it would have a 5.6% tax rate, and so on up to the maximum of 9.75%. The prebate of the MI FairTax is like the personal exemption of the current income tax.

Q: How will this effect state government?
A: It will simplify tax collection, provide a more stable revenue and prevent the government from picking winners and losers. Politicians,  bureaucrats and lobbyists will no longer be able to manipulate the state tax code.

Q: How will this effect local government?
A: It will make all revenue sharing constitutional giving cities, townships, villages, and counties a number on which they can reliably plan their budget.

Q: Will the Michigan FairTax tax business-to-business transactions?
A: No! There will be no tax on any business purchases. Any tax on a business must be added to the price of the product being produced and this causes the product to be less competitive in the market place.

On March 16th 2006, in violation of US court orders and laws, Ryoko covertly boarded a flight on ANA (a Japanese flagship carrier) and illegally kidnapped Melissa to Japan.

Patrick Braden has set aside his personal career for the last 3 years to work in Washington DC on the issue of International Child Abduction with a specific focus on Japan and their defiant disregard of International Children’s rights, US laws, international treaties and other related issues.

Melissa BradenOn March 11th 2009, after 2 years of work on Capitol Hill,and partly with the support from the recent high level publicity regarding the Sean Goldman case, House Resolution 125 was passed with a unanimous roll call vote in the US House of Representatives. This Resolution will benefit thousands of children and their left behind parents, affected by the plight of International Child Abduction.

The only way that Patrick can parent his child at this point is to continue his work to bring her home. Japan has refused to sign onto the Hague Convention Treaty and has never returned a single abducted child back to the United States.

Some Interesting Statistics as Reported in House Resolution 125 (March 11th, 2009)

According to the Department of State, there are 51 cases involving 65 children who were habitual residents of the United States and who were removed to Brazil by a parent and have not been returned to the United States as required under the Hague Convention.

According to the Department of State’s April 2008 Report on Compliance with the Hague Convention on the Civil Aspects of International Child Abduction, `parental child abduction jeopardizes the child and has substantial long-term consequences for both the child and the left-behind parent’.

The Department of State’s Office of Children’s Issues, while not always notified of international child abductions, is currently handling approximately 1,900 open cases of parental abduction to other countries involving more than 2,800 children abducted from the United States.

According to the Department of State, in fiscal year 2008, the United States Central Authority counted 306 cases of parental abductions involving 455 children taken from the United States to other countries that are not partners with the United States under the Hague Convention, currently including 101 children in Japan, 67 children in India, and 37 children in Russia.

Three-year-old Melissa Braden is among the children who have been wrongfully abducted to Japan, a United States ally which does not recognize intra-familial child abduction as a crime, and though its family laws do not discriminate by nationality, Japanese courts give no recognition to the parental rights of the non-Japanese parent, fail to enforce United States court orders relating to child custody or visitation, and place no effective obligation on the Japanese parent to allow parental visits for their child.

Melissa was taken from Los Angeles, California to Japan on March 16, 2006, when she was 11-months-old, despite a California court’s prior order forbidding Melissa’s removal to Japan and granting joint custody to her father Patrick Braden.

Despite his extensive efforts, Mr. Braden and his daughter have not seen each other since her abduction.

According to the Department of State, abducted children are at risk of serious emotional and psychological problems and have been found to experience anxiety, eating problems, nightmares, mood swings, sleep disturbances, aggressive behavior, resentment, guilt and fearfulness, and as adults may struggle with identity issues, their own personal relationships and parenting.

Left-behind parents may encounter substantial psychological, emotional, and financial problems and many may not have the financial resources to pursue civil or criminal remedies for the return of their children in foreign courts or political systems.


About the Hague Convention as applicable to Child Custody and Jurisdiction involving minors

The Hague Convention of 1996  is the third of the modern Hague Conventions . Its full title is Convention of 19 October 1996 on Jurisdiction, Applicable Law, Recognition, Enforcement and Co-operation in respect of Parental Responsibility and Measures for the Protection of Children. It is much broader in scope than the first two conventions, covering a wide range of civil measures of protection concerning children, from orders concerning parental responsibility and contact to public measures of protection or care, and from matters of representation to the protection of children’s property.

It also covers:

  • Parental disputes over custody and contact

The Michigan 20th District Senate seat, currently occupied by Republican Tom George who is term limited, is up for grabs in the 2010 elections. There is more at-stake than just the one seat in this race, with 30 of Michigan’s 38 Senate Seats up for heated contests around the State. Republicans currently hold a majority of Michigan Senate Seats. It is anticipated that Wenke will face a Primary challenger, Tonya Schuitmakers (Republican MI-Rep-80th District), in the coming election.
